Due to the priority visa processing policy made by the DIAC, tens of thousands of valid Australian GSM applicants have been put in limbo for an uncertain time frame.. In fact, there is no time for them, while all the other applicants, who paid the same amount of application fees and tax, have been jumping the queue so frequently.. There has not been solid evidence that the priority processing is serving Austrlia’s economy needs much better than its absence, while tens of thousands people’s lives have been given a considerable uncertainty.. Thus many of these people, known as the GSM G5ers, have finally seek to take legal actions against the DIAC.. Now G5ers have received advice from Migration Agent and Solicitor, David Harvey, that 70 contributions for the legal action against the DIAC for a fair go for the GSM G5ers have been received and allocated.. The first step towards legal action may be considered as “has completed”.. So David has advised that no further payment shall be made at this stage.. We just quoted the email below:..     Descriptive info: View.. What links here.. There is a group of people in Australia who love this country and did a lot of hard work to try to stay.. They submitted a valid application when they met all the requirements set by the Department of Immigration.. However, many of them have been waiting for a decision of their application for more than 2 years.. It is 3 years and even more for some of them.. Now this group of people seem to be forgotten: their application will only be assessed when the application of Group 1, 2, 3 and 4 have all been finalized.. What does this mean? Basically, the group 1, 2, 3 ,4 are having new applications all the time, which means there is no estimated time frame for Group 5 to know when their application will even be assess (not to mention to be approved to become a Australian Permanent Residence).. Most of the Group 5 are allowed to work full time while they are waiting.. But they never know when or whether they will be accepted after this endless waiting time.. Many of Group 5 applicants speak fluent English (IELTS 7 and above).. They have many Aussie friends and are used to the life style in this  ...   made.. The factor that this is happening in Australia where people all believe in a fair go is heart breaking.. Group 5 Applicants are really crying for help.. This is not about cutting down immigrations: the reduce of migration plan is doing it as a fact! This is not about stopping the boat: all group 5 applicants have submitted a valid application and met all the requirement set by law under the Australia General Skilled Migration plan.. This is not about stealing Australian's job: many of the group applicants are allowed to work and are working already.. This is about fairness: simple concept that you might say no when you see people jumping the queue to buy movie tickets.. We should stop that.. People's application should be assess in due course.. Even if priority is necessary, an endless waiting time is just nothing near fairness.. Priority processing arrangements.. Most General Skilled Migration (GSM) visa applications are subject to a Ministerial Direction which determines the priority in which they are considered.. Under the Direction allocation of applications to a case officer for processing is done based on the priority of an application according to the Direction.. Each week within the two GSM processing centres (Adelaide and Brisbane) the highest priority applications on hand are allocated before the next highest until sufficient applications are allocated to deliver the GSM component of the 2011-12 Migration Program.. See: Migration Program Statistics.. Each week around 1000 priority affected cases are allocated to case officers.. These allocations are currently made up of all available applications from Priority Group 1 and 3, with the balance being Priority Group 4 cases.. There are no GSM visa subclasses in Priority Group 2.. As of 18 November 2011 there are around 751 applications lodged in Australia and 5544 applications lodged from outside Australia Priority Group 4 cases awaiting allocation..
